1. INTRODUCTION
1.1 The User refers to the person accessing this website and accepting the terms and conditions of LMV Tutoring Ltd. The Tutor provides the teaching service. The Student is the beneficiary of the service, and the Client or Payee is responsible for the payment. LMV Tutoring Ltd. will be referred to as “The Company”, “We”, “Our,” or “Us”. The term “Course”, “Tuition”, and “Programme” refers to the services agreed upon between the Client and LMV Tutoring Ltd.
1.2 LMV Tutoring Ltd. is a Limited Company providing tutoring services.
1.3 LevelUPwithSara is the project name and website offering chemistry courses and private tuition.
1.4 We may change these Terms as required at any time. We will inform all parties involved promptly. Continued use of the services will indicate acceptance of these changes.
2. LIMITATION OF LIABILITY
2.1 LMV Tutoring Ltd. will not be held liable for any indirect, incidental, or consequential damages, including but not limited to, loss of data, loss of profits, or business interruption, arising from the use or inability to use our digital services, even if we have been advised of the possibility of such damages.
2.2 In no event shall LMV Tutoring Ltd.’s total liability to you for all damages, losses, and causes of action exceed the amount paid by you, if any, for accessing or using the digital content and streaming services.
2.3 LMV Tutoring Ltd. is not responsible for any technical issues, including but not limited to internet connectivity problems, software compatibility issues, or device malfunctions, that may prevent the Student from accessing the downloaded content or streaming videos.
3. COPYRIGHT
3.1 The copyright of all resources, branding, and website graphics, except where otherwise stated, are the property of Sara Lorini. In line with the Copyright, Designs, and Patents Act of 1988, Sara Lorini or LevelUPwithSara must be identified as the author of this work. The author reserves all rights.
3.2 You may not:
- Share or reproduce purchased electronic resources.
- You may not download, reproduce, transmit, use, or incorporate any of the LevelUP with Sara branding, photographs, website text, files, videos, or blog posts without the prior written consent of Sara Lorini.
- Copy the course layout, the design of the notes, any content, or the LevelUpstyle quizzes.
4. ENROLLING IN A COURSE
4.1 The User warrants that they have the legal capacity to enter a binding contract with LevelUPwithSara.
4.1.1 If the User is under 18, the User must have obtained full consent from his/her parent or legal guardian, and both Student and Parent warrant they are fully aware of the Terms upon which the LevelUpwithSara courses are made available to them.
4.1.2 If a Parent signs up, they agree to the Terms set out in these Terms and Conditions on behalf of the Student.
4.2 The User must provide a valid email address on registration.
4.2.1 The User must confirm their email address via the link in the confirmation email.
4.2.2 The courses are hosted on Google Classroom, so the Student must provide an active and working email address different from their school email. This ensures they can access all course materials without restrictions imposed by school email systems.
4.2.3 The User must ensure they keep their confirmation link and registration details secure and not provide this information to any third party unless explicitly granted permission from LMV Tutoring Ltd.
4.2.4 The User is responsible for all activity under the User’s account, even if someone else uses that account.
5. PRICES AND PAYMENTS
5.1 All prices listed on the Website are correct at the time of publication. However, we reserve the right to alter these in the future.
5.2 A Student can purchase a LevelUpwithSara Course for themselves, acting as their own Payee, or a Parent can purchase a Course on behalf of a Student, acting as a Payee.
5.3 LevelUpwithSara will take all reasonable care, in so far as it is in our power to do so, to keep the details of the User’s order and payment secure. Still, in the absence of negligence on our part, we cannot be held liable for any loss the User may suffer if a third party procures unauthorized access to any data the User provides when accessing or ordering from the Website.
5.3.1 The Payee’s debit/credit card details will be encrypted to prevent the possibility of someone being able to read them as they are sent over the internet; the Payee’s credit card company may perform security checks to confirm that you are making the order.
5.4 If LevelUPwithSara does not receive a payment on time, we reserve the right to suspend or cancel the Student’s participation in the LevelUPwithSara Course, and further access to LevelUPwithSara may be denied to the Student and Parent.
6. TUTORING
6.1 The Student:
- Is responsible for attending the lesson at the established time.
- Must ensure that WiFi and devices are appropriate and functioning before the lesson.
- Should be prepared a couple of minutes before the lesson, waiting for the code and password.
- Is responsible for taking notes and completing set homework.
- Is responsible for talking to the tutor in case of issues with how the lesson is performed.
- Should communicate directly with the tutor for arrangements and cancellations only if the parent allows.
- Should access GOOGLE CLASSROOM to download notes, if indicated by the tutor.
- Should communicate in advance to the tutor if the session should be recorded.
- Must inform the tutor in case of cessation of tuition.
- Should not share the access code to GOOGLE CLASSROOM, private, or from the courses, with other students.
- Agrees to have parts of the lessons recorded. The recordings will exclude the student’s face, but comments and voices might be recorded if students participate verbally. However, we aim to primarily capture the tutor’s explanation, minimizing any inclusion of the student’s identity. The purpose is to upload educational YouTube videos to benefit the student while minimizing the video length.
6.2 For the Parent/Guardian:
- Is responsible for paying for the lessons on time using the agreed-upon method.
- Is responsible for communicating with the tutor about lesson rearrangements or cancellations.
- Keep an eye on the availability calendar to ensure the lesson is booked at the correct time and remind the student about it.
- Should communicate with the tutor for any issue related to the lessons.
- If paying monthly, the parent should pay the invoice fully within a week of the invoice date.
6.3 For the Tutor:
- Is responsible for providing a lesson of 55-60 minutes.
- Is responsible for providing the lesson at the agreed-upon time and communicating in advance for any delay.
- Is responsible for using appropriate resources, notes, and exercises for the lesson.
- Is responsible for updating the availability calendar and booking the sessions at the agreed-upon times.
- Should communicate directly with the parent or student for booking sessions and payments.
- Is responsible for providing a high-standard lesson using appropriate resources.
- Is responsible for keeping the GOOGLE CLASSROOM section updated.
- Is available to share the notes and papers used in the lesson with the student.
- It does not guarantee that the notes, videos, and any material shared are free of typographical or photographic errors. The tutor will update the notes according to changes in exam boards, but this does not warrant that the notes are complete and accurate.
- Is responsible for keeping the slot booked for the regular students but might require rearrangements occasionally.
6.4 Cancellations:
- The parent or student (if responsible for doing so) can cancel the lesson up to 12 hours before the set time.
- If cancelled up to 12 hours before the lesson, the fee will be kept if paid in advance, and the lesson will be rescheduled.
- If the lesson is cancelled between 12 and 1 hour before the lesson, 50% of the payment is taken as a cancellation fee.
- The total fee must be paid if the lesson is cancelled less than 1 hour before the lesson.
- The total fee must be paid if the student does not attend the lesson.
- Extenuating circumstances may be accepted (health of the student or family, transport accidents), but a justification must be given as soon as possible.
- If more than 3 sessions are cancelled, the service might be suspended.
- The tutor will wait 15 minutes; if the student does not show up or communicate with the tutor, the lesson and payment will be lost.
- These terms are valid for parents and students.
- The tutor should be able to cancel at any time, with appropriate notice.
- In case of technical problems (WiFi, Zoom, etc.), the lesson may be shortened (if the tutor cannot prolong it) or rearranged.
7. TERMINATION FOR CONVENIENCE
7.1 Either party may terminate this Agreement at any time without cause by providing written notice to the other party at least 30 days in advance.
7.2 Upon termination for convenience by the Client, the Client will be responsible for paying for all digital services rendered up to the termination date. Any remaining balance for services not yet rendered will be refunded to the Client, provided the Student has not accessed or downloaded any content or viewed any streaming videos.
7.3 LMV Tutoring Ltd. reserves the right to terminate this Agreement for convenience with the same 30-day notice, ensuring
