1.1 The following terminology applies to these Terms and Conditions, Privacy Statement, and Disclaimer Notice and any or all Agreements: “User”, “Student”, “You,” and “Your” refer to you, the person accessing this website and accepting the Company’s terms and conditions. “Tutor” refers to the person that provides the teaching service, “Student,” “Participant” refers to the beneficiary of the service, and “Client,” “Payee” refer to the person responsible for the payment of the service. “The Company”, “Ourselves”, “We”, “Our,” and “Us” refer to our LMV Tutoring Ltd. “Party”, “Parties”, or “Us” refer to both the Client and ourselves, or either the Client or ourselves. “Course”, “Tuition”, and “Programme” refer to the tuitions agreed upon between the Client and LMV Tutoring Ltd.

 

1.2 LMV Tutoring Ltd. is a Limited Company that provides tutoring services.

 

1.3 LevelUPwithSara is the project name and the website that provides chemistry courses and private tuition.

 

1.3 These Terms may be changed by Us as required, at any time. We will inform all parties involved of such changes promptly. Continued use will mean acceptance of the changes.

 

2. COPYRIGHT

 

2.1 The copyright of all resources, branding, and website graphics, except where otherwise stated, are the property of Sara Lorini. In line with the Copyright, Designs, and Patents Act of 1988, Sara Lorini or LevelUPwithSara must be identified as the author of this work. All rights are reserved by the author.

 

2.2 You may not:

 Share or reproduce purchased electronic resources.

 Download, reproduce, transmit, use, or incorporate any of the LevelUP with Sara branding, photographs, website text, files, videos, or blog posts without the prior written consent of Sara Lorini.

 Copy the course layout, the design of the notes, any content, or the LevelUpstyle quizzes.

 

3. ENROLLING IN A COURSE

 

3.1 The User warrants that the User has the legal capacity to enter a binding contract with LevelUPwithSara.

 

3.1.1 If the User is under the age of 18, the User must have obtained full consent from his/her parent or legal guardian, and both Student and Parent warrant they are fully aware of the Terms upon which the LevelUpwithSara courses are made available to him/her as set out in these Terms and Conditions.

 

3.1.2 If a Parent signs up, they are agreeing to the Terms set out in these Terms and Conditions on behalf of the Student.

 

3.2 The User must provide a valid email address on registration.

 

3.2.1 The User must confirm their email address via the link in the confirmation email sent to them.

 

3.2.2 The User must set a password when completing their account registration.

 

3.2.3 The User must ensure that they keep their confirmation link and registration details secure and must not provide this information to any third party unless explicitly granted permission from LMV Tutoring Ltd.

 

3.2.4 The User is responsible for all activity under the User’s account even if someone else uses that account.

 

3.3 LevelUpwithSara Courses purchased from this Website are intended for use by the Student only.

 

3.4 LevelUpwithSara reserves the right to alter the LevelUpwithSara Courses available for sale on the Website and to discontinue any Course.

 

3.5 Any students under the age of 18 must have parental/legal guardian’s permission before signing up for tuition.

 

3.6 The delivery of material and the scheduled live lessons may change date, with previous notice.

 

4. PRICES AND PAYMENTS

 

4.1 All prices listed on the Website are correct at the time of publication. However, we reserve the right to alter these in the future.

 

4.2 A Student can purchase a LevelUpwithSara Course for themselves, acting as their own Payee, or a Parent can purchase a Course on behalf of a Student, acting as a Payee.

 

4.3 LevelUpwithSara will take all reasonable care, in so far as it is in our power to do so, to keep the details of the User’s order and payment secure, but in the absence of negligence on our part, we cannot be held liable for any loss the User may suffer if a third party procures unauthorized access to any data the User provides when accessing or ordering from the Website.

 

4.3.1 The Payee’s debit/credit card details will be encrypted to prevent the possibility of someone being able to read them as they are sent over the internet; the credit card company of the Payee may do security checks to confirm it is you making the order.

 

4.4 If LevelUPwithSara does not receive a payment on time, we reserve the right to suspend or cancel the Student’s participation in the LevelUPwithSara Course, and further access to LevelUPwithSara may be denied to the Student and Parent.

 

5. TUTORING

 

5.1 For the Student:

  • Is responsible for attending the lesson at the established time.
  • Must ensure that WiFi and devices are appropriate and functioning before the lesson.
  • Should be prepared a couple of minutes before the lesson, waiting for the code and password.
  • Is responsible for taking notes and completing set homework.
  • Is responsible for talking to the tutor in case of issues with how the lesson is performed.
  • Should communicate directly with the tutor for arrangements and cancellations only if allowed by the parent.
  • Should access GOOGLE CLASSROOM to download notes, if indicated by the tutor.
  • Should communicate in advance to the tutor if the session should be recorded.
  • Must inform the tutor in case of cessation of tuition.
  • Should not share the access code to GOOGLE CLASSROOM, private, or from the courses, with other students.
  • Agrees to have parts of the lessons recorded. The recordings will exclude the student’s face, but comments and voices might be recorded if students participate verbally. However, our aim is to primarily capture the tutor’s explanation, minimizing any inclusion of the student’s identity. The purpose is to upload educational YouTube videos to benefit The Student while minimizing the video length.

 

5.2 For the Parent/Guardian:

  • Is responsible for paying for the lessons on time by the method agreed upon.
  • Is responsible for communicating with the Tutor for lesson rearrangements or cancellations.
  • Should keep an eye on the availability calendar to make sure the lesson is booked at the correct time and to remind the student about it.
  • Should communicate with the tutor for any issue related to the lessons.
  • If paying monthly, the parent should pay the invoice fully within a week of the invoice date.

 

5.3 For the Tutor:

  • Is responsible for providing a lesson with a length of 5560 minutes.
  • Is responsible for providing the lesson at the agreedupon time and communicate in advance for any delay.
  • Is responsible for using appropriate resources, notes, and exercises for the lesson.
  • Is responsible for updating the availability calendar and booking the sessions at the agreedupon times.
  • Should communicate directly with the parent or the student, if allowed, for booking sessions and payments.
  • Is responsible for providing a highstandard lesson using appropriate resources.
  • Is responsible for keeping updated the GOOGLE CLASSROOM section.
  • Is available to share with the student the notes and papers used in the lesson.
  • Does not guarantee that the notes, videos, and any material shared are free of topographical or photographic errors. The tutor will update the notes according to changes in exam boards, but this does not warrant the notes to be complete and accurate.Is responsible for keeping the slot booked for the regular students but might require rearrangements occasionally.

 

5.4 Cancellations:

  • The parent or student (if responsible for doing so) can cancel the lesson up to 12 hours before the set time.
  • If canceled up to 12 hours before the lesson, the fee will be kept if paid in advance, and the lesson will be rescheduled.
  • If the lesson is canceled between 12 and 1 hour before the lesson, 50% of the payment is taken as a cancellation fee.
  • If the lesson is canceled less than 1 hour before the lesson, the full fee must be paid.
  • If the student does not attend the lesson, the full fee must be paid.
  • Extenuating circumstances may be accepted (health of the student or family, transport accidents), but a justification must be given as soon as possible.
  • If more than 3 sessions are canceled, the service might be suspended.
  • The tutor will wait 15 minutes, and if the student does not show up or does not communicate with the tutor, the lesson and payment will be lost.
  • These terms are valid for parents and students.
  • The tutor should be able to cancel anytime, with appropriate notice.
  • In case of technical problems (WiFi, Zoom, etc.), the lesson may be shortened (if the tutor cannot prolong it) or rearranged.
  •  If any of these terms and conditions are violated, tuition, access to the course, and private notes may be ceased immediately.

 

5.5 Privacy:

  • Student and parent information and contact details are safely kept by the tutor for communication purposes.
  • Communications are done through WhatsApp when possible. The parent and student automatically agree to receive updates regarding the tuition.
  • The Google Classroom will be archived after a month of cessation of tuition.

 

6. LIVE GROUP LESSONS

 

6.1Privacy Protection:

We prioritize the privacy of all students under 18 participating in our live group lessons. Personal information will be handled securely and in accordance with applicable data protection laws.

 

6.2 Camera Choice:

Students have the option to keep their camera on or off during the live group lessons. It’s entirely their choice, and their decision will be respected.

 

6.3  Parental Consent: 

For students under 18, parental or guardian consent is required for participation in our live group lessons.

 

6.4  Responsibility: 

We do not bear responsibility for ensuring students’ attention and attendance during the lessons. It is the responsibility of the student and their parents/guardians to manage their participation and engagement.

 

6.5  Course Inclusion: 

Live group lessons are included in the purchase of the course, offering students the opportunity to participate in interactive learning sessions.

 

6.6  NonMandatory Attendance: 

Attendance in live group lessons is not mandatory. Students are free to join or skip the sessions based on their preferences and schedules.

 

6.7  Notification Consent: 

By participating in our live group lessons, students consent to receiving notifications, including the Zoom link and other relevant information, via their provided email address.

 

6.8  Recording Policy: 

Live lessons may be recorded for educational purposes. The recordings will exclude the student’s face, but comments and voices might be recorded if students participate verbally. However, our aim is to primarily capture the tutor’s explanation, minimizing any inclusion of the student’s identity.

 

6.9  Technical Setup: 

We use Zoom for our live group lessons. Participants, especially students under 18, are responsible for ensuring they have the necessary technical setup (e.g., Zoom account, compatible devices) to access and participate in the lessons.

 

7. CANCELLATION AND TERMINATION 

 

7.1 The Payee may cancel the Agreement and receive a full refund within 7 working days of purchasing a Course provided the Student has not logged in and accessed the Course.

 

7.2 Once a Student has accessed a Course, the Payee is entitled to cancel further participation in a Course at any time, but previous payments are no longer refundable.

7.4 LevelUPwithSara is entitled to cancel or suspend a User’s access to LevelUPwithSara or LevelUPwithSara Courses and/or terminate this Agreement if we reasonably consider or suspect that the User has acted in breach of these Terms and Conditions.

 

7.5 LevelUPwithSara may cancel or suspend a User’s access to LevelUPwithSara or LevelUPwithSara Courses and/or terminate this Agreement with immediate effect if at any time:

 

7.5.1 LevelUPwithSara reasonably considers or suspects that the User has committed any breach or nonobservance of any of the provisions of this Agreement;

 

7.5.2 The User commits any gross misconduct affecting the business of LevelUPwithSara or any fraud or dishonesty or acts in any manner which in the opinion of LevelUPwithSara brings or is likely to bring LevelUPwithSara into disrepute or is materially adverse to the interests of LevelUPwithSara;

 

8. LEVELUPWITHSARA HONOUR CODE 

 

8.1 All Students who participate in a LevelUPwithSara Course must agree to abide by the following code of conduct:

 

8.1.1 I will not engage in any activity that may dishonestly improve my results.

 

8.1.2 I will selfmark my own work honestly, accurately, and to the best of my ability to maximize my improvement.

 

8.1.3 My answers to quiz questions, memorization exercises, or exam practice sessions will be my own work entirely.

 

8.1.4 I will not make my solutions to quiz questions, memorization exercises, or exam practice sessions available to anyone else.

 

8.1.5 I will not share any of the LevelUPwithSara Course material, whether content or exercises, with anyone else.

 

8.2 If the student does not follow the honour code, LevelUPwithSara reserves the right to suspend the course access or tutoring immediately, without a refund.

 

9. WARRANTIES AND LIABILITIES 

 

9.1 The User warrants that the User Material is and will be an original work and has not been and will not be copied wholly or substantially from any other work or material or any other source and that no part of the User Material shall:

 

9.1.1 Infringe any third party Rights;

 

9.1.2 Contain anything which is defamatory, libelous, obscene, or otherwise unlawful;

 

9.1.3 Contain any viruses, Trojan horses, worms, time bombs, or other computer programming routines that are intended to damage, detrimentally interfere with, surreptitiously intercept, or expropriate any system, data, or personal information.

 

9.2 The User shall fully reimburse and defend LevelUPwithSara from and against any damages, costs, and expenses suffered or incurred by LevelUPwithSara or awarded by any court

 

9.3 Payment Processing:

 

9.3.1 Payment transactions are securely processed through Stripe, a reputable online payment gateway. LevelUPwithSara does not store or have access to your payment details, ensuring a high level of security for all financial transactions.

 

9.3.2 The User acknowledges and agrees that any payment-related issues or disputes are to be resolved directly with Stripe, and LevelUPwithSara will not be held responsible for any such matters.

 

9.3.3 By using Stripe as the payment gateway, both the User and LevelUPwithSara adhere to the terms and conditions set forth by Stripe, ensuring a transparent and secure payment process for all parties involved.
